9th Circuit Court Dismisses
Environmental Groups’ Bid to Close Sharp Park

Only two weeks after hearing oral arguments, the U.S. Court of Appeals for the 9th Circuit  dismissed the appeal of environmentalist groups led by Wild Equity Institute and Center for Biological Diversity on Wednesday, March 25.

The groups were appealing the the U.S. District Court’s December 6, 2012 decision dismissing their lawsuit to close Alister MacKenzie’s historic Sharp Park Golf Course.  Both the District Court and the Court of Appeals held that the case was moot.  Or as attorney Joseph Palmore – representing the defendants – put it “Moot squared”.  A great big thanks to Morrison-Foerster, a major national environmental litigation law firm, based in San Francisco, that has handled the litigation for the San Francisco Public Golf Alliance on a pro bono basis.  For the complete story, click here.
